These Terms of Use ("Terms") govern your access to and use of the ZazGlo website, mobile application, and related services (collectively, the "Services") provided by ZazGlo, Inc. ("ZazGlo," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.

1. Eligibility

The Services are intended only for users who are at least 16 years old. By using the Services, you represent and warrant that you are at least 16 years old and are legally able to enter into these Terms. Learn more about why ZazGlo is for 16+ →

2. License to Use the Services

Subject to these Terms, ZazGlo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use. You may not use the Services except as expressly permitted by these Terms.

3. User Accounts

Some features of the Services may require you to create an account. You agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for:

• maintaining the confidentiality of your login credentials;
• all activities that occur under your account; and
• notifying us promptly of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts that are inaccurate, inactive, fraudulent, abusive, unlawful, or otherwise in violation of these Terms.

4. Account Deletion

If you create an account, you may request deletion of your account through the in-app settings or as otherwise described in the Services. When you request deletion, we will delete your account and associated personal data except where we need to retain certain information for legitimate business or legal purposes, including security, fraud prevention, compliance, dispute resolution, or recordkeeping.

5. Acceptable Use

You agree not to, and not to permit any third party to:

• use the Services for any illegal, fraudulent, or unauthorized purpose;
• violate any applicable law, regulation, or third-party right;
• copy, reproduce, distribute, publicly display, publicly perform, republish, download, or transmit any part of the Services except as expressly allowed by us;
• modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive source code, underlying ideas, algorithms, or structure from the Services, except where such restriction is prohibited by law;
• interfere with or disrupt the Services or the servers, systems, or networks connected to the Services;
• attempt to gain unauthorized access to any account, system, database, or network related to the Services;
• use any robot, scraper, crawler, data-mining tool, or other automated means to access, extract, monitor, or copy any part of the Services;
• impersonate any person or entity, or falsely suggest an affiliation with any person or entity;
• upload, transmit, or distribute viruses, malware, malicious code, or other harmful content;
• infringe, misappropriate, or violate our intellectual property rights or the intellectual property rights of others; or
• use the Services to build, train, benchmark, or support any competing product or service.

6. User Content

You may be able to submit, upload, store, or otherwise provide content through the Services, including text, images, preferences, routines, feedback, or other materials ("User Content"). You retain ownership of your User Content. However, by providing User Content through the Services, you grant ZazGlo a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, modify solely for formatting or technical purposes, display, perform, and otherwise use your User Content as necessary to operate, provide, maintain, improve, support, and promote the Services.

You represent and warrant that:

• you own or control all rights necessary to provide the User Content;
• your User Content does not violate any law or third-party right; and
• your User Content is accurate to the extent you present it as factual.

We may remove or restrict access to User Content at any time if we believe it violates these Terms, applicable law, or the rights of any person.

7. Feedback

If you provide suggestions, ideas, feedback, or recommendations regarding the Services ("Feedback"), you agree that we may use that Feedback for any purpose without restriction, notice, or compensation to you.

8. Intellectual Property

The Services, including all software, designs, interfaces, visual elements, text, graphics, logos, icons, trademarks, service marks, trade dress, flower displays, shelf displays, and all related content, features, and functionality, are owned by ZazGlo, Inc. or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, disclose, and protect information.

10. Medical Disclaimer and No Medical Advice

Your use of the Services is also subject to our Medical Disclaimer. The Services are provided for informational, educational, organization, and personalization purposes only. ZazGlo does not provide medical advice, medical diagnosis, or medical treatment. Any health-related or skincare-related information, recommendations, routines, product matches, or other outputs made available through the Services are not a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of a qualified healthcare professional regarding any medical or health condition and before making significant changes to any skincare, wellness, or health-related routine.

11. No Guaranteed Results

The Services may provide personalized information, product matches, routine suggestions, displays, or recommendations based on information you provide and other factors. These outputs are informational only and do not guarantee any result, outcome, suitability, or improvement.

12. Service Availability and Changes

We may modify, update, suspend, or discontinue all or any part of the Services at any time, with or without notice. We do not guarantee that the Services, or any content or features within the Services, will always be available, uninterrupted, secure, or error-free.

13. Termination

We may suspend, restrict, or terminate your access to all or any part of the Services at any time, with or without notice, if:

• you violate these Terms;
• we believe your conduct creates risk, legal exposure, or harm to us, other users, or third parties; or
• we decide to discontinue the Services or any part of them.

Upon termination, the rights granted to you under these Terms will immediately end.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAZGLO, INC. DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAZGLO, INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:

• YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES;
• ANY CONTENT, OUTPUT, OR RECOMMENDATIONS MADE AVAILABLE THROUGH THE SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA; OR
• ANY OTHER MATTER RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ZAZGLO, INC. FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ZAZGLO, INC. FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) US$100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

16. Indemnification

You agree to defend, indemnify, and hold harmless ZazGlo, Inc., its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

• your use of the Services;
• your User Content;
• your violation of these Terms; or
• your violation of any law or third-party right.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of those courts.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the "Last Updated" date above. Your continued use of the Services after the updated Terms become effective means you accept the revised Terms.

19. General Terms

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and ZazGlo, Inc. regarding the Services and supersede any prior or contemporaneous agreements relating to the Services. If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms without restriction.
